This is a really important issue that is long overdue for rectification. The current discount rate leads to those with serious lifelong injuries being under compensated.
Lawyers have forced ministers to release the results of a long-running review into the formula used to deduct interest from compensation awards for life-long injuries. Whitehall lawyers have confirmed that the review results will be published by January 31 next year in a move prompted by a second threat of judicial review proceedings. The Association of Personal Injury Lawyers first told the government that it would force the issue through the courts nearly six years ago. After that threat the Ministry of Justice, under Ken Clarke as lord chancellor, vowed to conduct a review of the regime. But the lawyer claimed that process was kicked into the long grass and again threatened judicial review proceedings two months ago.
